1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of brateai.com and all related services (the “Service”) provided by Bahi Hiba Limited, registered in Abuja, Nigeria(“BrateAI,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this minimum age requirement and have the legal capacity to enter into these Terms.

The Service is not intended for users in jurisdictions where AI relationship advice services are restricted or prohibited. You are responsible for compliance with your local laws.

3. Account Registration

To use most features of the Service, you must create an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activity that occurs under your account

You may not share your account credentials or allow others to access your account. We may suspend or terminate accounts that we determine are being misused or shared in violation of these Terms.

4. The Service

BrateAI provides AI-powered tools for relationship guidance, including conversational advice, text generation, image generation, voice playback, and compatibility analysis. The Service uses third-party AI models (currently provided by OpenAI) to generate responses based on the prompts and information you submit.

Important: BrateAI is not a substitute for professional advice.

The Service provides general information and AI-generated responses that may be helpful for everyday relationship questions and reflection. The Service is NOT:

  • Medical advice, therapy, or a substitute for licensed mental health care
  • Legal advice or a substitute for consultation with a lawyer
  • Crisis intervention or emergency response
  • A licensed counseling service

If you are experiencing a mental health crisis, contemplating self-harm, or in an emergency, please contact your local emergency services or a licensed mental health professional immediately. Crisis hotlines are available in most countries; search for resources in your area.

5. Acceptable Use

You agree not to use the Service to:

  • Submit content that violates any law or third party’s rights
  • Generate content that is illegal, harassing, hateful, threatening, or sexually explicit involving minors
  • Impersonate any person or entity
  • Attempt to bypass our security, rate limits, or access controls
  • Use the Service to harm, defraud, manipulate, stalk, or surveil others
  • Reverse engineer, decompile, or attempt to extract our source code or AI models
  • Scrape, crawl, or harvest data from the Service
  • Submit content you do not have the right to share
  • Use the Service for any purpose other than your personal, non-commercial use, except as expressly permitted by us in writing
  • Resell, sublicense, or share access to your account or our services

We reserve the right to remove content and suspend or terminate accounts that violate these rules.

6. Subscriptions and Payments

Plans

We offer free and paid plans. Paid plans currently include the EXPERIENCE plan (one-time purchase), MONTHLY plan (recurring), and ANNUAL plan (recurring). Plan features, included credits, and pricing are displayed on our pricing page and may be updated from time to time.

Billing

Subscription fees are charged in advance to your chosen payment method through Stripe at the start of each billing period. Prices are listed in United States Dollars (USD) unless otherwise stated. Applicable taxes may be added.

Automatic renewal

Recurring subscription plans automatically renew at the end of each billing period at the then-current price, until canceled. You authorize us to charge your payment method for these renewals.

Cancellation

You may cancel your recurring subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period; you will retain access through the end of that period.

Refunds

Refund requests are reviewed on a case-by-case basis at BrateAI’s sole discretion. To request a refund, contact us at support@brateai.com with details about your charge and the reason for your request. We may approve, deny, or partially approve refund requests based on the specific circumstances. Where applicable consumer protection law requires a refund, we will comply with those requirements.

Price changes

We may change pricing for new subscription periods. We will notify you of price changes at least 30 days before they take effect for your account. If you do not agree to the new pricing, you may cancel before the change takes effect.

Failed payments

If your payment method fails, your subscription may be temporarily suspended. We may attempt to charge your payment method again. After repeated failures, your subscription may be canceled.

7. Credits

Many features of the Service consume credits. Credit costs for each feature are displayed in the Service and may be updated from time to time. Credits:

  • Are granted as part of your plan or via top-up purchases
  • Are not transferable between accounts
  • Have no monetary value and cannot be redeemed for cash
  • May expire as specified in your plan terms
  • Are non-refundable once consumed
  • May be revoked if granted in error or obtained through fraud or abuse

We reserve the right to adjust credit costs for features as the Service evolves. We will provide advance notice of material cost increases.

8. Intellectual Property

Your content

You retain ownership of the content you submit to the Service (“Your Content”). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit Your Content for the purpose of operating, improving, and providing the Service to you.

AI-generated content

Subject to your compliance with these Terms, you may use the responses generated by the Service for your own personal purposes. Note that AI-generated content may not be unique to you, and other users may receive similar responses for similar prompts. We make no representations about the uniqueness, accuracy, or fitness for any particular purpose of AI-generated content.

Our content

The Service itself, including its design, software, branding, logos, and documentation, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without our written permission.

Feedback

If you provide feedback or suggestions about the Service, we may use them without restriction or compensation to you.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • AI-generated responses will be accurate, complete, useful, or appropriate for your situation
  • Defects will be corrected
  • The Service will meet your requirements

AI-generated content may contain errors, omissions, or inappropriate suggestions. You are responsible for evaluating the suitability and accuracy of any response before acting on it.

10. Limitation of Liability

To the maximum extent permitted by law:

We are NOT liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, use, goodwill, or other intangibles, arising out of or in connection with your use of the Service.

Our total liability to you for all claims arising from or related to the Service is limited to the greater of: (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) US$50.

These limitations apply regardless of the legal theory (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless BrateAI, Bahi Hiba Limited, and our officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your violation of these Terms
  • Your violation of any third party’s rights
  • Your misuse of the Service
  • Content you submit through the Service

12. Termination

You may stop using the Service and delete your account at any time through your account settings.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason at our discretion.

Upon termination:

  • Your right to use the Service ends immediately
  • Your account and associated data may be deleted in accordance with our Privacy Policy
  • Unused credits and subscription periods are forfeit, except where required by law
  • Provisions of these Terms that by their nature should survive termination will continue to apply

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects when these Terms were last revised. Material changes will be communicated to you via email or a notice within the Service.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and may cancel your subscription.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of laws provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Where you reside in a jurisdiction with mandatory consumer protection laws, those laws may apply in addition to these Terms.

15. Dispute Resolution

Before pursuing any formal dispute, you agree to first contact us at support@brateai.com to attempt to resolve the matter informally. We will respond within 30 days.

If we cannot resolve the dispute informally, any dispute arising from or related to these Terms or the Service will be resolved in the courts located in Abuja, Nigeria, except where prohibited by applicable law.

Some jurisdictions may require local courts and consumer dispute resolution. Those rights remain available where mandated by law.

16. Miscellaneous

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrateAI regarding the Service.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

No waiver

Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

We may provide notices to you via email, in-Service notifications, or postings on brateai.com. You may provide notices to us at support@brateai.com.
